Abstract: | The year 2023 marked a breakthrough in Vietnam's national digital transformation, especially in the field of digital data. Vietnam has performed well in this endeavor, making significant strides in modernizing the collection, use, and management of citizen data. In 2022, the government issued Decree 59/2022/NĐ-CP regulating electronic identity, electronic identification, electronic authentication; electronic authentication services; rights, obligations of users of electronic authentication services; responsibilities of related agencies, organizations, individuals1 , applicable to Vietnamese agencies, organizations, citizens; organizations, foreigners residing, operating in Vietnam related to electronic identification and authentication2 . Furthermore, personal identification data strongly impacts the country's digital economic flow. Therefore, the collection, transformation, and utilization of a large amount of citizen data of a nation require a well-developed, progressive, and effectively applicable legal framework. However, Vietnam's current legal system regarding this issue is still quite limited and not fully developed. Reality shows that the application of these regulations in practice still has many shortcomings, contradictions, leading to unforeseen consequences. In the spirit of contributing opinions, suggestions for the construction and improvement of separate laws on electronic identification, personal data in the future, in this study, the author team will clarify the details of the limitations of electronic identification data, the access rights of state agencies to personal data, and their impact on Vietnam's economic flow. From there, propose directions, solutions for data limitation work in comparison with theoretical bases and practicalities to exploit, use, and protect citizen's personal data in the process of implementing electronic identification work |
